1. Subscription Grant

Subject to this Agreement and payment of the applicable recurring fee, InJest grants you a non-exclusive, non-transferable, revocable license to install and use the InJest application ("the Software") on the number of devices permitted by your subscribed tier, for as long as your subscription remains active. This is a license to use the Software, not a sale of it: InJest retains all right, title, and interest in the Software itself. Your right to use the Software ends when your subscription is cancelled, expires, or is otherwise no longer active, subject to the free trial terms in Section 4.

2. Tiers & Concurrent Devices

Your subscription permits the Software to be signed in on a limited number of devices at the same time, determined by the tier you subscribed to:

• Solo: 1 device signed in at a time.
• Duo: 2 devices signed in at a time.

There is no permanent binding to any specific device and no limit on how many times you may sign in on a new device over the life of your subscription, only a limit on how many devices may be signed in concurrently. Signing in on a device that would exceed your tier's limit prompts you to confirm before the oldest other active device is signed out, so this should only be done once you're sure that device isn't in the middle of an active operation. A device that loses network connectivity retains its slot for a 7-day grace period before InJest automatically frees it.

3. Billing, Cancellation & Refunds

Subscriptions are billed on a recurring monthly or yearly cycle, in advance, via Razorpay (for customers in India) or Paddle (for customers everywhere else). You may cancel at any time from within the Software (Settings > Account & Subscription); cancelling stops future renewals but does not refund any amount already paid, and you retain access through the end of the period you already paid for. Upgrading from Solo to Duo takes effect immediately, cancelling your current subscription and starting a new one, with no refund or credit for the unused remainder of the cancelled cycle. Downgrading from Duo to Solo cancels your Duo subscription at the end of your current billing cycle, and you retain Duo access until then; picking up Solo afterward requires subscribing to it separately, from within the Software or the website, and does not happen automatically. If a renewal payment fails, InJest continues to grant full access while your payment provider automatically retries the charge; if every retry fails, your subscription is marked halted and access is suspended until payment succeeds or you subscribe again. All charges are otherwise final: because a subscription grants immediate access to the full Software for the period paid, InJest does not offer refunds beyond what is described above, except where required by applicable law.

4. Delivery

InJest is downloadable software, delivered entirely digitally - there is no physical product and nothing is shipped. Once your account is active (trial or paid subscription), you can download and install the Software immediately from injest.app; access to Ingest, Import, the Media Encoder, Transfer, Projects, and Library begins as soon as installation and sign-in are complete. Because delivery is instant and digital, there is no shipping timeline, shipping cost, or physical exchange process of any kind.

5. Free Trial

InJest may be used without an active subscription, free of charge and without a credit card, so you can evaluate the Software before subscribing. The trial period is 30 days, starting the first time you open and sign in to the Software (not from account creation on the website), and provides full, unrestricted access to Ingest, Import, the Media Encoder, and Transfer for that entire period; Projects and Library are never limited. The trial ends, and the entire Software locks, once 30 days have elapsed. The trial is tied to both your account and the specific device it was first used on: it does not renew by creating a new account, and does not renew by using a different device once your account's own trial period has elapsed, whichever of the two comes first. To prevent trial abuse, InJest attempts to verify that a device is genuine physical hardware before granting a trial period on it; if this cannot be verified, which can occur inside virtual machines or on certain unusual hardware configurations, no trial period is available on that device. This verification applies only to the free trial and has no effect on a subscribed device. Once any subscription, admin-granted access, or coupon-based access has been applied to your account, the free trial is permanently superseded: it is not restored if that access later expires, is cancelled, or is not renewed. Trial use is subject to the same restrictions as a subscribed copy.

6. Coupon Codes

InJest may from time to time issue coupon codes granting a free period before the first billing charge. Redeeming a coupon code still requires authorizing a real, recurring subscription mandate with your payment provider (Razorpay or Paddle, as described in Section 3); no charge is made until the free period you were granted ends, after which billing proceeds as described in Section 3. Each coupon code may be redeemed once, by one account, and cannot be resold or transferred.

7. Restrictions

You may not:

• Resell, sublicense, rent, lease, or otherwise transfer your account or subscription to another person or organization.
• Sign in on more devices at the same time than your tier permits.
• Reverse engineer, decompile, or disassemble the Software, except to the extent applicable law expressly permits despite this restriction.
• Remove or alter any proprietary notices contained in the Software.
• Use the Software to develop a competing product.

8. Ownership

The Software, including its source code, design, and documentation, is and remains the property of InJest's developer. This Agreement does not grant you any rights to trademarks or branding associated with InJest. You retain full ownership of any footage, metadata, and files you process using the Software: InJest claims no rights over your content.

9. Term & Termination

This Agreement is effective from the date you first sign in to the Software and continues until terminated. It terminates automatically if you breach any term of this Agreement, or if your subscription is cancelled, halted, or otherwise ends without renewal (subject to the free trial terms in Section 4), in which case you must stop using the Software beyond what any remaining trial allowance permits. Sections that by their nature should survive termination (including Ownership, Disclaimer of Warranty, and Limitation of Liability) survive.

10. Updates

An active subscription entitles you to free updates released within your subscribed tier for as long as your subscription remains active. InJest may, but is not obligated to, release new tiers or paid upgrades in the future; this Agreement does not guarantee free access to functionality introduced after your subscription began if it is offered as a separate paid tier.

11. Disclaimer of Warranty

The Software is provided "as is," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. You are responsible for maintaining independent backups of any footage you consider irreplaceable: no ingest or backup tool, including InJest, should be your only copy.

12. Limitation of Liability

To the maximum extent permitted by law, InJest's developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of footage, or loss of profits, arising from your use of or inability to use the Software, even if advised of the possibility of such damages. In no event shall total liability exceed the amount you paid for your subscription in the 12 months preceding the claim.

13. Governing Law

This Agreement is governed by the laws of India, without regard to its conflict of law principles.
